Rebecca Taylor's exposé is nice and clear but I'm suspicious. She says that cross border sales will be allowed by Article 16, but this is what Article 16 says: “Member States shall prohibit retail outlets established on their territory from engaging in cross border distance sales.”

    Tobacco products directive: invitation to press conference

    European Parliament rapporteur Linda McAvan (S&D, UK) will hold a press conference on Wednesday, following the Committee of Permanent Representatives (COREPER) meeting which will examine a possible compromise on article 18 of the draft legislation, which sets up a regulatory framework for electronic cigarettes.

    Under the compromise to be discussed by COREPER, e-cigarettes should be regulated either as medicines or as tobacco products. In the latter case, they should not contain nicotine in a concentration of more than 20 mg/ml.

    Refillable cartridges would be allowed, albeit with certain safeguards. A single cartridge should contain the equivalent in nicotine of a pack of cigarettes, the draft says. Electronic cigarettes should be childproof, and should carry health warnings. They would be subject to the same advertising restrictions as tobacco products.
